Wills vs. Trusts: What's the Difference?

A will is a prepared document that is only legally executed in the case of your death. Chiefly, it concerns what should be done with any remaining assets left behind.

A will should do the following:

  • Select executioner to assign any final wishes
  • Name beneficiaries and division of assets
  • Choose a guardian for any children (if the deceased was guardian)
  • Decide medical issues in the case the grantor becomes physically incapacitated

A trust is only different in that selects a trustee, a person or an entity (like a bank or corporation) to hold on to certain assets or property for a temporary amount of time, but then is legally bound to release those assets to a designated beneficiary. Trusts are often useful when money is left to children who are still very young. In these cases, a trustee holds on to this money until the children reach a predetermined age and then releases the money.

Many feel that creating these documents themselves is enough to be legally binding, but too many times wills and trusts are thrown out in court on technicalities and ambiguities. When this happens, it maybe be up to a family member, or even a probate judge to then divide your assets. That's why it's crucial that you seek competent legal counsel to assist in the establishment of these documents. At Buckmaster & Ellzey, we know how to craft clear, airtight wills and trusts that will both stand up in court and guide your family through the decisions you've made for them.
